QUALIFICATIONS - for LMIA-Based Work Permits

An LMIA-Based Work Permit is a closed (employer-specific) work permit that allows a foreign worker to work in Canada only for the employer who obtained an LMIA.

LMIA stands for Labour Market Impact Assessment — a document issued by Employment and Social Development Canada (ESDC) that confirms:

“No Canadian citizen or permanent resident is available to do this job, so we’re approving the employer to hire a foreign worker.”

WHAT IS REQUIRED

To qualify for an LMIA-based work permit, both the employer and the applicant must meet certain criteria:

For the Worker (You)

  • A valid job offer from a Canadian employer with an approved LMIA

  • Skills, education, and experience relevant to the position (proof may be required)

  • English or French proficiency (depends on job, not always tested formally unless needed)

  • Medical exam (for jobs in healthcare, child/elder care, or if staying over 6 months)

  • Police clearance (basic background check)

  • No inadmissibility issues (e.g. past visa refusals, criminal history, health risks)

For the Employer:

  • Must apply for and receive a positive LMIA from ESDC

  • Must show proof of recruitment efforts to hire Canadians first

  • Must pay a processing fee (CAD $1,000 per position)

  • Must provide a genuine, full-time job offer with standard wages and working conditions
